It also describes your rights with respect to your personal data. By registering on or using our Site, you agree to the collection and use of information in accordance with this Privacy Policy. This Policy is displayed prominently on our Site, and you must consent to it as part of our user registration process. If you do not agree with any part of this Privacy Policy, please do not use the Site or provide us with your personal information.

  • Real Estate Services: As a registered user, you are a client of Sam Navidi. We will use your contact information to communicate with you regarding properties or real estate inquiries. For example, we may respond to your requests for more property info, send you listings that match your saved search criteria, or update you about the status of properties you have shown interest in.
  • Personalized Experience: We may use data about your searches and viewed listings to tailor the service to your needs. For instance, we might highlight new listings similar to ones you viewed or notify you of price changes on a property you liked.
  • Account Administration: We’ll use your information for administrative purposes, such as sending account verification emails, password reset messages, or important updates to our Terms or this Policy. We also use it to confirm your agreement to our Terms of Use and to track that you have acknowledged required disclosures (like the Privacy Notice and Consent form).
  • Compliance and Audit: Importantly, we may use and share your information as needed to comply with real estate board rules and legal requirements. For example, the Real Estate Board may request access to our VOW records (which include your registration data and audit logs of your site activity) for auditing or legal compliance purposes. We use your information to fulfill such obligations and ensure both you and we are in compliance with all applicable rules.
  • Improvement of Services: We may analyze how users utilize the Site (in aggregate form) to troubleshoot issues, improve search functions, add new features, and enhance overall user satisfaction.

  • With Our Brokerage and Team: Sam Navidi is a licensed REALTOR® operating under a brokerage (e.g., ReMax). Your information may be shared within our real estate team or with our brokerage’s administrative staff as needed to facilitate service to you. For example, if Sam works with an assistant or co-realtor, they might access the data to set up property tours or handle paperwork on Sam’s behalf. All such persons are bound by confidentiality and professional ethics.
  • With the Real Estate Board or Regulatory Authorities: We may share your registration and usage information with the Real Estate Board and/or regulatory bodies (such as the Real Estate Council or Superintendent) for auditing, monitoring, or legal compliance purposes. This could include confirming that you agreed to the required Terms of Use, or investigating any alleged misuse of data. The Board may access our VOW system to ensure rules are followed. Any such access will be strictly for compliance or enforcement of rules and laws.
  • Service Providers: We might employ third-party companies for website hosting, maintenance, email delivery, or analytics. These providers may have access to personal information only to perform specific tasks on our behalf (e.g., storing the website data on a secure server, or sending out a verification email). They are not permitted to use your info for any other purpose and must protect it in accordance with applicable privacy laws.
  • In a Transaction Process: If you progress from using the Site to actually engaging in a real estate transaction with Sam Navidi (such as making an offer on a property or listing your home), there will be additional personal information needed (like your property details, offer terms, etc.). Such information will be used in the context of those transactions and shared with relevant parties (e.g., the other party’s agent, lawyers, mortgage brokers, or inspectors) only as necessary to carry out the transaction and only with your knowledge.   • Business Transitions: In the unlikely event that Sam Navidi or his brokerage changes (for example, Sam changes brokerages, or if the SamNavidi.ca site or business is merged or transferred), your information might be transferred as part of that change so that your service can continue with minimal interruption. In such case, you would be notified of any change in data control and your options.

4. Data Retention

We will retain your personal information for as long as necessary to fulfill the purposes outlined in this Policy, or as required by real estate board rules and law, whichever is longer. Specifically, the VOW rules require us to maintain a record of your name, email, and username for at least 180 days after your account password expires or is terminated. We may keep data longer if needed for an ongoing business relationship or to comply with legal record-keeping (e.g., real estate transactions often require records to be kept for several years). If you deactivate your account or it remains inactive, we may archive your information securely. Should you wish to reactivate within a certain period, we can restore your account. After the required retention period, we will securely delete or anonymize your personal data if it is no longer needed.

5. Security Measures

We take reasonable precautions to safeguard your personal information:
  • The Site is protected with industry-standard security (HTTPS encryption for data in transit, secure servers for data at rest).
  • Passwords are encrypted, and our databases are access-controlled.
  • We limit access to personal information to only those who need it (Sam Navidi and authorized personnel/service providers).

However, please understand that no method of transmission over the Internet or method of electronic storage is 100% secure. We cannot guarantee absolute security of information. You also play a role in security: protect your password and login credentials. We will never ask you for your password via email. If you suspect any security breach or unauthorized access to your account, notify us immediately so we can assist.

We will provide you with a copy of the data we have on file for you, typically within 30 days. If any of your information is inaccurate or outdated, please let us know, and we will correct it. Note that if you withdraw consent or delete your account, you will no longer have access to the MLS® listing data through our Site.

Transactional communications (like verification emails or direct responses to your inquiries) are not optional as they are part of the service, but we keep those limited and pertinent.
  • Disclosure of Other Agents: As mentioned in our Terms, we require that you not be under another agency agreement when using our services. If your situation changes (for example, if you enter an agreement with another Realtor or no longer want to work with us), you have the right and responsibility to inform us so we can handle your data appropriately (possibly by deactivating your access in compliance with rules).
  • Cookies: Most browsers allow you to manage cookie settings. If you prefer, you can usually remove or reject cookies via your browser settings. However, doing so might affect your ability to use certain features of our Site (such as staying logged in).

7. Children’s Privacy

Our services are not intended for individuals under the age of 19 (the age of majority in BC for entering binding real estate agreements). We do not knowingly collect personal information from anyone under 19. If you are under 19, please do not register on the Site. If we discover that we have inadvertently collected personal data from a minor without parental consent, we will delete that information. Parents or guardians who believe we might have information about an underage child should contact us to ensure it is removed.
